Notice of Public Hearing for Further Amendments to By-Law No. 7406

A public hearing for further amendments to water and wastewater Development Charges will be held on Monday, June 9, 2025, at 7 p.m. at City Hall Council Chambers.

This public hearing will only pertain to policy surrounding the proposed provision to phase high density, water and wastewater Development Charges over a three-year period, with the phasing percentages of 25%, 50% and 100% only being applied to the proposed rate increase.

New Transportation and Land Drainage Rates under By-Law No. 7397

City Council adopted By-Law No. 7397 on April 7, 2025, increasing Development Charges for transportation and land drainage network infrastructure at the time of building permit. Revised rates will take effect on June 6, 2025.

Updated policies and rates can be found within the Consolidated Development Charges By-Law No. 7175 (As amended by By-Law No. 7397).

Consolidated Development Charges By-Law No. 7175

Details of the revised Development Charges By-Law include:

  • Updated rates, included in Schedule B of the By-Law, are updated annually in accordance with:
    • Statistics Canada’s Consumer Price Index (Manitoba) for water and wastewater rates; and
    • Statistics Canada’s Building Construction Price Index (Winnipeg, Division Composite, Non-residential Buildings) for transportation and land drainage rates.
  • The rates differ based on the type of use and where the development occurs.
  • Reductions may apply when redevelopment occurs (e.g. demolishing a house and building a duplex) or when previous development agreement contributions have been paid for applicable service categories.
  • A credit towards transportation and land drainage rates will be applied when previously approved development sites located in the Emerging Growth Area paid Development Charges at the time of development agreement.

Proposed Development Charge Amendments Under By-Law No. 7406

Currently, water and wastewater Development Charges (DC) are approved under the Public Utilities Board of Manitoba (PUB). It is estimated that the PUB approval process will take several months from the application submission date. Given this timeline, and to align capital infrastructure needs with updated DC rates, amendments to By-Law No. 7175 have been carried out through two sequential by-laws:

  • The first amendment, By-Law No. 7397, includes updated rates for transportation and land drainage network infrastructure, general housekeeping provisions, new policy surrounding DC rates, and lists capital infrastructure projects (passes by Council on April 7, 2025); 
  • The second amendment, By-Law No. 7406, addresses the remaining rates for water and wastewater treatment and network infrastructure and outstanding general housekeeping provisions (amendments ongoing).

 

By-Law No. 7406 was presented to the Council for first reading on November 18, 2024 and given first reading as amended on January 20, 2025.

Following City Council direction on February 3, 2025, the Audit and Finance Committee (AFC) completed a review of the proposed DC rates and is recommending further amendments to By-Law No. 7406. The recommendation includes the phasing of high density, water and wastewater DC rates over a three-year period, with the phasing percentages of 25%, 50% and 100% only being applied to the proposed rate increase.

The AFC will bring forward the proposed phasing amendments to By-Law No. 7406 for Council’s consideration following a new public hearing. By-Law No. 7406 cannot proceed to second reading until the PUB has issued a board order.

Why are Development Charges Needed?

As Brandon grows, the need for new municipal infrastructure becomes increasingly important. Development Charges (DC) provide one method to help fund the construction of essential off-site infrastructure to ensure the city can continue to grow over the next 20 years. The infrastructure supported by DCs include transportation, water, wastewater, and land drainage. 

While developers are responsible for constructing on-site infrastructure within the boundaries of new neighbourhoods, the City is responsible for constructing the necessary off-site infrastructure. Through the collection of DCs, the City of Brandon can fund the growth-related costs associated with the off-site infrastructure needed to service new development and redevelopment within the City. This approach ensures a consistent distribution of costs in line with the City’s commitment to fairness and transparency.
